Complaints & Guidance

One of the ways The Manitoba Securities Commission protects the public interest is by regulating the real estate and mortgage broker industries. This includes registering real estate brokers and agents who help the public buy, sell or manage properties. It also includes mortgage brokers who help the public find mortgage financing. The Commission also investigates complaints and can take action against real estate brokers, agents and mortgage brokers who do not follow the rules.

The MSC can:

  • Investigate complaints.
  • Answer general questions about how real estate brokers, agents and mortgage brokers are required to conduct business.
  • Tell you if a real estate broker, agent or mortgage broker is registered in Manitoba.
  • Tell you if a real estate broker, agent or mortgage broker has been disciplined by the MSC.
  • Suggest options for pursuing your complaint and tell you which organization may be of the most help.
  • Enforce compliance with real estate and mortgage broker legislation.
  • Take action against a real estate broker, agent or mortgage broker where there has been misconduct, including the suspension or cancellation of registration.
  • In certain circumstances where trust money paid as part of a real estate transaction is missing, take action to seek financial recovery for you from the Real Estate Reimbursement Fund.

The MSC cannot:

  • Undo a transaction
  • Give advice on a real estate or mortgage broker transaction
  • Give legal advice
  • Negotiate a settlement on your behalf
  • Comment on an investigation
